How to Lodge your DA on the NSW Planning Portal | StraightLine Planning

Before starting, you will need to register for a NSW Planning Portal account.


 

Local development is the most common type of development in New South Wales, covering projects ranging from home extensions to medium-sized commercial, retail and industrial ventures.


For these developments, obtaining consent through an approved Development Application (DA) is essential.


A development is classified as local if:


  • A Local Environmental Plan (LEP) or State Environmental Planning Policy (SEPP) specifies that consent is required, and

  • The project is not deemed Regionally Significant Development or State Significant Development.

Understanding Local Environmental Plans (LEPs)


Local Environmental Plans (LEPs) guide decision-making for land use within local government areas across NSW.


These plans establish zoning and development controls that dictate how land can be used and developed.


LEPs include regulations on matters like building height and permissible uses for properties zoned for housing, industry or recreation.


These plans are enforced under the Environmental Planning and Assessment Act 1979 (EP&A).


Understanding State Environmental Planning Policies (SEPPs)


State Environmental Planning Policies (SEPPs) provide a framework for statewide land use, ensuring streamlined urban and regional development. SEPPs establish legal guidelines to expedite planning processes and are reviewed regularly to ensure their relevance and effectiveness.


Applying for Local Development Consent


Step 1: Determine if Consent is Required


To determine if consent is needed, consult zoning tables within relevant LEPs and SEPPs for your area.


Use the NSW Planning Portal Spatial Viewer to assess zoning constraints and rules affecting your property. The Spatial Viewer provides digital maps and detailed information for all lots and addresses in NSW.

Each LEP or SEPP categorises development as:


  • Development that does not require consent

  • Development that requires consent

  • Development that is prohibited


If consent is required, you must lodge a Development Application with the local council.





Step 2: Lodge a Development Application


A Development Application (DA) formally requests approval to proceed with your project.


As of July 2021, applications must be submitted online through the NSW Planning Portal. A DA must include:


  • A description of the development

  • Estimated project cost

  • Site plan

  • Development plans

  • Environmental assessment documentation, such as an Environmental Impact Statement (EIS) or a Statement of Environmental Effects (SEE).

Development consents are typically issued by local councils or, in cases specified by SEPPs, by the Minister for Planning.
